This End-User License Agreement ("EULA") is a legal agreement between you and Alexander Asher
This EULA agreement governs your acquisition and use of Tube Runner software ("Software") directly from Alexander Asher or indirectly through a Alexander Asher authorized reseller or distributor (a "Reseller").
Please read this EULA agreement carefully before completing the installation process and using the Tube Runner software. It provides a license to use the Tube Runner software and contains warranty information and liability disclaimers.
If you register for a free trial of the Tube Runner software, this EULA agreement will also govern that trial. Installing or using the Tube Runner software, you are confirming your acceptance of the Software and agreeing to become bound by the terms of this EULA agreement.
If you are entering into this EULA agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity and its affiliates to these terms and conditions. If you do not have such authority or if you do not agree with the terms and conditions of this EULA agreement, do not install or use the Software.
This EULA agreement shall apply only to the Software supplied by Alexander Asher herewith regardless of whether other software is referred to or described herein. The terms also apply to any updates, supplements, Internet-based services, and support services for the Software, unless other terms accompany those items on delivery. If so, those terms apply.
YOUR USE OF THE MOBILE APP IS AT YOUR SOLE RISK. THE MOBILE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TUBE RUNNER EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
Alexander Asher hereby grants you a personal, non-transferable, non-exclusive licence to use the Tube Runner software on your devices in accordance with the terms of this EULA agreement.
You are permitted to load the Tube Runner software (for example a mobile or tablet) under your control. You are responsible for ensuring your device meets the minimum requirements of the Tube Runner software.
You are not permitted to:
Alexander Asher shall at all times retain ownership of the Software as originally downloaded by you and all subsequent downloads of the Software by you. The Software (and the copyright, and other intellectual property rights of whatever nature in the Software, including any modifications made thereto) are and shall remain the property of Alexander Asher.
Alexander Asher reserves the right to grant licences to use the Software to third parties.
From time to time, Tube Runner App may offer additional products and services for purchase through the App Store or Google Play store or other application platforms ("in app purchases").
If you choose to make an in app purchase, you will be prompted to enter details for your account with the mobile platform you are using (e.g., Apple, etc.) ("your IAP Account"), and your IAP Account will be charged for the in app purchase in accordance with the terms disclosed to you at the time of purchase as well as the general terms for in app purchases that apply to your IAP Account.
If you purchase an auto-recurring periodic subscription through an in app purchase, your IAP Account will be billed continuously for the subscription until you cancel in accordance with the platform terms.
In call cases, please refer to the terms of your application platform which apply to your in app purchases.
If you purchase an auto-recurring periodic subscription through an in app purchase, your IAP Account will be billed continuously for the subscription until you cancel.
After your initial subscription commitment period, and again after any subsequent subscription period, your subscription will automatically continue for an additional equivalent period, at the price you agreed to when subscribing.
If you do not wish your subscription to renew automatically, or if you want to change or terminate your subscription, you will need to log in to your IAP account and follow instructions to cancel your subscription, even if you have otherwise deleted your account with us or if you have deleted the Tube Runner App application from your device.
Deleting your account on Tube Runner App or deleting the Tube Runner application from your device does not cancel your subscription. Tube Runner App will retain all funds charged to your IAP Account until you cancel your subscription through your IAP Account.
Your subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period. Auto-renewal may be turned off at any time by going to your settings in the iTunes Store after purchase.
Generally, all charges for purchases are nonrefundable, and there are no refunds or credits for partially used periods. We may make an exception if the laws applicable in your jurisdiction provide for refunds. For subscribers residing in the EU or European Economic Area, in accordance with local law, you are entitled to a full refund during the 14 days after the subscription begins. Please note that this 14-day period commences when the subscription starts.
To request a refund, use the store that you originally made the purchase in (e.g. App Store)
This EULA agreement is effective from the date you first use the Software and shall continue until terminated. You may terminate it at any time upon written notice to Alexander Asher.
It will also terminate immediately if you fail to comply with any term of this EULA agreement. Upon such termination, the licenses granted by this EULA agreement will immediately terminate and you agree to stop all access and use of the Software. The provisions that by their nature continue and survive will survive any termination of this EULA agreement.
This EULA agreement, and any dispute arising out of or in connection with this EULA agreement, shall be governed by and construed in accordance with the laws of korea.
